Hill, Jr., 296-1888             Elkhart County Prosecuting Attorney Curtis T. Hill, Jr. announced that a charge of Murder was filed against Mariano Sonora Marquez on April 15, 2004 for the shooting death of Manuel M. Aguirre which occurred on January 19, 1999 at the 7-11 convenience store located on the southwest corner of old U.S. 20 and Middleton Run Road, Elkhart.  In addition to the charge of Murder, Marquez has been charged with Aggravated Battery related to the injury to Cheri L. Miller who was inside of the 7-11 store at the time of the shooting and suffered a gunshot wound to her lower back.The case was originally investigated by the Elkhart County Sheriff’s Department in early 1999 although charges were not filed at that time.  It late 2003, prosecutor’s investigator David Gizzi developed information pertaining to the Aguirre homicide investigation and initiated a review and further investigation.  The shooting occurred at 11:27 p.m.  Video surveillance located at 7-11 detailed Aguirre’s arrival at the store and exit from his vehicle.  The tape continued to record Aguirre as shots were fired and he fell to the ground.  Miller is observed on the surveillance tape reacting to her injury and the suspect’s vehicle is observed pulling away following the scene.Although the murder charge was authorized by Hill and filed in April of 2004, the file was sealed by Elkhart Circuit Court Judge Terry Shewmaker at the request of Hill to allow local investigators and federal authorities the opportunity to locate Marquez.    Although several leads have been developed, Marques currently remains at large and is also wanted in California on a failure to appear in court for a 2001 Kidnapping charge.  After contact with the F.B.I. office in South Bend was made, a federal warrant was also issued for unlawful flight to avoid prosecution for murder.Anyone with information on Mariano Sonora Marquez should contact Investigator David Gizzi at the Office of the Prosecuting Attorney at (574) 296-1888 or www.ElkhartCountyProsecutor.com. ***
