DEFINITIONS

Deputy Prosecuting Attorney – The attorney who prosecutes the misdemeanor that is subject of the Misdemeanor Diversion Agreement

Misdemeanor Diversion – Program that allows a citizen to avoid a misdemeanor conviction if he/she complies with all program requirements

Misdemeanor Diversion Agreement – The formal agreement citizens have with the Office of the Prosecuting Attorney for Elkhart County that outlines the terms and conditions that must be completed to receive dismissal of the misdemeanor offense

Misdemeanor Diversion Coordinator – The contact person at the Prosecutor’s Office who manages the Misdemeanor Diversion Program

Perjury – To give false or misleading information under oath

Proof of Financial Responsibility – Certain types of violations require persons to provide us with proof of current auto insurance coverage
