*** MEDIA ADVISORY *** August 25, 2005                                                         FOR IMMEDIATE RELEASE  GRAND JURY HANDS DOWN INDICTMENTS IN MOOSE GAMBLING INVESTIGATION AND GARCIA HOMICIDE MEDIA CONTACT:  Curtis T. Hill, Jr., 296-1888             Elkhart County Prosecuting Attorney Curtis T. Hill, Jr. announced that the Elkhart County Grand Jury has handed down indictments in two (2) recent cases submitted to the grand jury by the Elkhart County Prosecuting Attorney’s Office.On the 2nd day of April, 2005, David G. Garcia was killed during an altercation involving several people.  Following the deliberations, the grand jury has issued indictments against Milagro Arredondo age thirty (30) years for Voluntary Manslaughter with a Deadly Weapon, a class A felony as well as indictments against Manuel Arredondo age forty-one (41) years for the offense of Involuntary Manslaughter as a class C felony and Daniel Arredondo age twenty-four (24) years for the offense of Battery as a class A misdemeanor.  A class A felony is punishable by up to fifty (50) years in prison.  A class C felony is punishable by up to eight (8) years in prison and a class A misdemeanor is punishable by no more than one (1) year in prison.“The Garcia death investigation was one involving complex facts because of the conduct of all the parties leading up to his death”, said Prosecuting Attorney Hill.  “Voluntary Manslaughter, under Indiana law, is killing another human being while acting under sudden heat”, said Hill.Milagro Arredondo has been arrested and her bond is set at One Hundred Thousand Dollars ($100,000.00).  Bond has been set for Manuel Arredondo in the amount of Fifteen Thousand Dollars ($15,000.00).   In the other case before the grand jury, stemming from the Prosecuting Attorney’s Office investigation into gambling at the Goshen Moose Lodge, the grand jury returned indictments against Mark Zimmerman, the administrator/manager of the Goshen Moose along with John Reiner, Marvin Wilsey, Michael Hartzell, Clifford Smeltzer, Robert Barnes, and William Skaggs, members of the board of directors for the Moose, charging each with Professional Gambling, a class D felony, Promoting Professional Gambling, a class D felony, and two (2) counts each of Unauthorized Activity, class B misdemeanors.  Warrants have been issued for each of them in the amount of Three Thousand Dollars ($3,000.00).“That there was illegal gambling at the Goshen Moose in October of 2004 was never a question.  The real issue centered around accountability for promoting the illegal activities and conducting their operation”, said Hill.  “The indictment of the administrative officer and members of the board of directors of the Goshen Moose addresses those responsible for the Moose’s activities.  There are some forms of gambling that are legal in the State of Indiana.  Other forms of gambling are not.  There are some forms of gambling that are illegal but otherwise permissible with the appropriate permit from the State of Indiana.  Other games are not permissible even with a permit.  Over the past two (2) years I have made it quite clear that this type of illegal behavior is not only unacceptable but that violations would be enforced.  There have been repeated examples of those enforcement measures, and yet some don’t get it.  Those are the people who should take heed of these grand jury indictments and reconsider their options when it comes to promoting or operating illegal activities in Elkhart County”, said Hill.***
