*** MEDIA ADVISORY*** April 18, 2013 PROBABLE CAUSE FOR ARREST IN GOSHEN MULTIPLE VICTIM SHOOTING Media Contact: Curtis T. Hill, Jr. - 296-1888 On Sunday, April 14, 2013, at approximately 9:30 p.m., officers of the Goshen Police Department responded to an emergency dispatch reporting a drive-by shooting in the area of Middlebury Street and School Street on the north side of Goshen, Indiana. Four individuals received injuries associated with the shooting, and each was treated and released from IU Health Goshen. The Goshen Police Department conducted an initial investigation which resulted in the April 15, 2013, arrest of five individuals GPD believed responsible for the shooting. The individuals arrested are ages 19, 16, 16, 16 and 15 years. The fifteen year old has been detained by the Juvenile Court with a hearing scheduled for Thursday, April 25, 2013. Indiana law requires police to submit information supporting the arrest (probable cause) to a judicial officer within 48 hours of the arrest. On April 17, 2013, officers of the Goshen Police Department submitted information from their investigation to a judicial officer. The judicial officer reviewed the information submitted by the Goshen Police Department and declined to find probable cause for arrest for the crimes articulated by the police. Thereafter, the Goshen Police Department reviewed their investigative materials and made another presentation, late Wednesday evening, April 17, 2013, to the judicial officer. At that time, the judicial officer determined that there was sufficient probable cause to support the arrests of the four individuals as follows: Diego Ramos, Age 19· Attempted Murder, a Class A Felony· Criminal Gang Activity, a Class D Felony Abraham Delgado, Age 16· Attempted Battery with a Deadly Weapon, a Class C Felony· Criminal Gang Activity, a Class D Felony Christian Bueno-Resendis, Age 16· Assisting a Criminal, a Class D Felony· Criminal Gang Activity, a Class D Felony Alejandro Bueno, Age 16· Criminal Gang Activity, a Class D Felony Probable Cause is defined as circumstances that would lead a reasonable person to believe that it is more likely than not that a person committed a crime and is required to determine that the detention of a person before trial is lawful. However, probable cause is not a determination of formal charges. Following the determination of probable cause by the judicial officer, the Prosecuting Attorney has 72 hours in which to make a formal decision relative to criminal charges, if any. While materials documenting the initial investigation by the Goshen Police Department have now been submitted to the Office of the Prosecuting Attorney, further investigation by the Goshen Police Department is necessary and ongoing. Upon such time as the Prosecuting Attorney believes that there is sufficient evidence to consider, he will make the determination on whether and/or what charges may be filed. ***Under Indiana law, all persons arrested for a criminal offense are innocent until proven guilty in a court of law.
